Landowners group filing lawsuit over hydrofracking study

A Binghamton-based group claiming 70,000 members is suing the state and Governor Andrew Cuomo over the lack of a decision on hydrofracking.


The Joint Landowners Coalition of New York represents people and companies who want to lease their land over the Marcellus Shale formation for natural gas and oil well exploration. They can't because the State Department of Environmental Conservation and the State Department of Health have never completed an environmental impact statement. The commissioners of both departments said at state budget hearings last week that they have no timeline for getting that review finished.


The landowners' coalition wants the courts to order state officials to cough up the ruling.


The coalition says not knowing whether the state will-or-won't allowing hydrofracking keeps its members from developing their mineral rights and causes them financial harm.
