Charges against a Livingston County man have been upgraded to second degree murder.
Livingston County Sheriff Thomas Dougherty says Gary Flemke is accused of intentionally causing the death of his wife, Marcia. He's now being held without bail.
Papers filed during Flemke’s arraignment say he shot his wife three times with a shotgun then tried to burn her body.
Flemke was first charged with evidence tampering after a body later identified as his wife's was found behind the couple's house.
Deputies had gone to check on the couple's welfare after an out-of-state family member grew concerned that he couldn't reach them. Deputies found the body, and after an all-day search located Flemke in a Dansville bar.
